1. Acceptance and scope
These Terms of Use govern the use of the iOS app “Planetarium Puzzle” (the “App”) provided by the individual developer Yamamoto Kanta (the “Operator”). By using the App, you agree to these Terms. If you do not agree, do not use the App. Apple’s applicable Media Services Terms and other applicable terms also apply where relevant.
2. License
Subject to these Terms and applicable law, the Operator grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the App for personal, non-commercial purposes. No ownership interest in the App is transferred to you.
3. Prohibited conduct
You must not violate laws or these Terms; infringe the rights of the Operator or others; unlawfully copy, modify, analyze, or reverse engineer the App; interfere with or gain unauthorized access to the App, contact function, or related servers; submit fraudulent, abusive, or spam inquiries; use the App as a basis for navigation, safety, research, professional, or other accuracy-critical decisions; or engage in other conduct the Operator reasonably determines to be inappropriate.
4. Intellectual property
Intellectual property rights in the software, text, images, designs, names, and other content in the App belong to the Operator or their lawful owners. The license under these Terms does not transfer those rights.
5. Astronomical information and permitted uses
Sky, constellation, date and time, meteor shower, and other astronomical information shown in the App is simulated using the selected observation location (Tokyo or Sydney), time, and other factors. The App does not guarantee actual visibility or observation results. Weather, terrain, light pollution, device displays, calculation errors, and other factors may cause differences from the real sky.
The App is intended for entertainment and learning. It must not be used for navigation; safety decisions, including travel or evacuation; research; observational records; official educational or professional decisions; or any purpose requiring accuracy. Consult appropriate official information, professional organizations, or dedicated equipment when accuracy is required.
6. Premium features and one-time purchase
The App offers “Planetarium Puzzle Premium” as a non-consumable in-app purchase. It unlocks the sky at a chosen date and time, the Southern Hemisphere/Sydney sky, and meteor shower mode. This is a one-time purchase, not an auto-renewing purchase or subscription.
The tax-inclusive price is shown in the App’s purchase screen and the App Store. Apple processes payments through StoreKit and the App Store. Apple’s terms and systems govern purchases, restoration, cancellation, and refunds. The Operator does not obtain or store credit card information. Refund requests must be made through Apple’s process. Nothing in this section limits consumer rights available under applicable law.
7. Changes, suspension, and termination
The Operator may change, suspend, or discontinue all or part of the App for maintenance, incident response, legal or platform requirements, or other reasonable reasons. Where the impact is significant, advance notice will be provided in the App or on this website where reasonably possible, except in emergencies or circumstances beyond the Operator’s control.
8. Disclaimer
The App is provided “as is.” To the extent permitted by law, the Operator does not warrant its accuracy, completeness, usefulness, fitness for a particular purpose, continuity, freedom from error or interruption, or operation on every device or OS. The App may be unavailable due to networks, devices, operating systems, the App Store, Apple services, weather, or other circumstances beyond the Operator’s control.
9. Limitation of liability
Where the Operator is liable for damage relating to the App, liability is limited to ordinary and direct damage, except where caused by the Operator’s willful misconduct or gross negligence. This limitation does not apply to the extent prohibited by the Consumer Contract Act or other applicable law. These Terms do not improperly restrict rights available to users under law.
10. Changes to these Terms
The Operator may change these Terms when laws or App functions change or when otherwise necessary. For material changes, the changes and effective date will be announced in advance by a reasonable method in the App or on this website. Revised Terms apply from the stated effective date.
11. Governing law
These Terms are governed by and construed under the laws of Japan. Disputes relating to the App or these Terms will be handled in accordance with applicable law.
